Image Based Abuse

Image based abuse (IBA) which is also sometimes called revenge porn or image based sexual abuse, is the term used to describe when an intimate image or video is shared without consent.

An intimate image or video includes one where an individual is naked, partially naked, engaged in sexual activity, toileting, showering, dressing or undressing.

In Fiji, it is against the law to post, send or share an intimate image or video of anyone without their consent. Giving consent means to agree or say that it is okay to share the image or video.

If persecuted under the Online Safety Act 2018, the penalties for an individual can be a fine up to $20,000 or up to 5 years in jail or both. In the case of a body corporate, the penalties can be up to $100,000 and up to $50,000 for the director, manager, or officer in charge or up to 7 years in jail or both.
